Library Membership Terms

Note: These terms are written in plain, firm language so you can actually read them. They are a binding agreement. If anything here is unclear, email us before you join, and please have your own advisor review them if you rely on them for an important decision.
These Library Membership Terms (the "Terms") are a legal agreement between you and Monitor My Air ("Monitor My Air," "we," "us," or "our") that governs your access to and use of the Monitor My Air Library (the "Library"), the community features, the free expert-matching directory, any consultations or advisory you purchase, and the websites and application through which we offer them. By creating an account, clicking to accept, subscribing, or otherwise using the Library, you agree to these Terms. If you do not agree, do not create an account and do not use the Library.
1. Who we are and what these Terms cover
Monitor My Air is operated from Virginia Beach, Virginia, United States. We publish general educational information about indoor air, moisture, mold, and related home and health topics, and we coordinate access to independent experts. We do not publish a physical mailing address; the way to reach us is by email, listed in the Contact section below.
These Terms apply to the Monitor My Air Library at mold.cx and its member application at app.monitormyairlibrary.com (together, the "Service"). These Terms specifically cover the Library and its application. Where these Terms refer to a separate policy, such as our Privacy Policy or Refund Policy, that policy is incorporated into these Terms by reference.
2. Eligibility
The Service is intended for adults. You must be at least 18 years old and able to enter into a binding contract to create an account or purchase a membership, consultation, or advisory. By using the Service, you represent that you meet these requirements, that the information you provide is accurate, and that you are not barred from using the Service under the laws of your jurisdiction. The Service is directed to users in the United States; if you access it from elsewhere, you are responsible for compliance with your local laws.
3. What the Library is
The Library is a paid membership that gives you access to:
- Educational content: written guides, articles, checklists, explainers, and reference materials created or curated by Monitor My Air to help you understand your home, your air, and related health topics in plain English.
- Community features: member discussion spaces where members can ask questions, share experiences, and support one another.
- Coordination and directory access: tools and information that help you find and understand your options, including our free expert-matching directory.
Alongside the membership, we may offer one-time consultations, a free expert-matching directory that is open without a paid membership, and higher-tier advisory services. Those offerings may carry their own scope, pricing, and terms presented at the point of purchase, and these Terms apply to them as well.
4. Education, not advice
This is the most important section, so please read it carefully. Monitor My Air provides general educational information and coordination only. The Library, the community, the directory, consultations, and advisory are informational and organizational in nature.
- The Service is not medical advice and is not a medical, clinical, diagnostic, or treatment service. Nothing in the Library diagnoses, treats, cures, or prevents any disease or condition.
- The Service is not a substitute for a licensed physician, industrial hygienist, home inspector, engineer, remediation contractor, attorney, or other qualified licensed professional.
- Using the Service does not create a doctor-patient relationship, a professional-client relationship, or any fiduciary or advisory relationship between you and Monitor My Air.
- Information you read, or discussions you have in the community, are a starting point for your own research and decisions, not a professional evaluation of your specific situation.
You should consult qualified, licensed professionals about your specific circumstances before making health, medical, remediation, structural, financial, or legal decisions. If you are experiencing a medical emergency, call your local emergency number or seek immediate care from a licensed medical provider. Never disregard or delay professional advice because of something you read or heard through the Service.
5. No guarantee of outcomes
Monitor My Air makes no guarantee, promise, or warranty of any result. Without limiting that, we do not guarantee any health outcome or improvement; any test, sampling, or laboratory result; any inspection finding; any remediation, repair, or prevention outcome; or that any condition, hazard, or problem in your home or environment will be found, identified, fixed, avoided, or prevented. Outcomes depend on many factors outside our control, including the condition of your property, the actions of third parties, and choices you make. Any examples, timelines, case studies, or estimates are illustrative only and are not a promise of the results you will experience.
6. Independent third parties
Inspectors, laboratories, industrial hygienists, remediation and repair contractors, physicians, and other experts that you find through our directory, that appear in our content, or that we otherwise reference are independent third parties. They are not employees, partners, agents, joint venturers, or representatives of Monitor My Air, and we do not control them.
- Monitor My Air does not perform, supervise, direct, endorse, warrant, or guarantee any third party's work, advice, pricing, availability, licensing, insurance, certifications, or conduct.
- You contract with those third parties directly. Any agreement, payment, scope, scheduling, dispute, or liability is between you and them.
- Listing, matching, or mentioning a third party is not a recommendation that you use them, and is not a representation that they are suitable for your needs. You are responsible for doing your own due diligence, including verifying licenses, insurance, references, and credentials.
To the fullest extent permitted by law, Monitor My Air is not liable for any act, omission, error, delay, damage, injury, cost, or loss caused by or arising from any third party you engage, whether or not you found them through the Service.
7. Membership, billing, and auto-renewal
Library membership is offered on recurring plans, currently on a monthly plan at US$5 per month. The exact current price, billing interval, and any applicable taxes are shown to you at sign-up and at checkout, and those displayed amounts govern.
- Recurring, auto-renewing subscription: when you start a paid membership, you authorize us and our payment processor to charge your payment method the then-current fee on a recurring basis. Your membership automatically renews at the end of each billing period (monthly or annual) at the then-current rate, until you cancel.
- Authorization: you authorize recurring charges to the payment method on file, including any updated card information your bank or card network provides, until you cancel or the membership ends.
- Failed payments: if a charge fails, we may retry the charge, and we may suspend or end your access if payment cannot be completed. You remain responsible for amounts properly owed.
- Free directory: the expert-matching directory is offered free of charge and does not require a paid membership. We may change what is free or paid over time.
8. Payments and your card information
Payments are processed by a third-party payment processor (currently Stripe). By purchasing, you also agree to the processor's terms. Monitor My Air does not store your full card number; card details are handled by the processor. You are responsible for keeping your billing information current and for any fees, taxes, or charges associated with your payment method. If your bank or card issuer imposes fees (for example, foreign transaction fees), those are your responsibility.
9. Cancellation
You can cancel your membership at any time from your account settings in the application, or by emailing us. When you cancel, your membership stops renewing, and your paid access continues until the end of the billing period you have already paid for. After that, your paid access ends and you are not charged again. Cancelling does not, by itself, delete your account or your community content unless you also ask us to close the account.
10. Refunds
Because the Library provides immediate access to digital content and community, fees are generally non-refundable once access has been made available or used, including for partial billing periods and for any renewal you did not cancel before it processed. Any exceptions, promotional trials, or specific refund windows are described in our Refund & Cancellation Policy, which is part of these Terms. Where a refund is required by applicable law, we will honor that requirement. Consultations and advisory may have their own cancellation and refund terms, which are presented when you book them.
11. Your account and security
- Provide accurate, current information when you register, and keep it up to date.
- Your account is for a single person. Do not share your login, and do not let others use your account.
- Keep your password confidential. You are responsible for all activity that occurs under your account.
- Notify us promptly at the Contact email if you suspect unauthorized use of your account or any security breach.
- We may refuse, suspend, or terminate accounts, reclaim usernames, and remove or reclaim access at our reasonable discretion, including to protect the Service or other members.
12. Acceptable use
You agree to use the Service lawfully and responsibly. You will not:
- Break any law, or infringe or violate anyone's rights, including intellectual property, privacy, or publicity rights.
- Post or transmit content that is unlawful, harassing, hateful, defamatory, threatening, abusive, obscene, or that harms or endangers others.
- Impersonate any person or entity, or misrepresent your affiliation with anyone.
- Upload viruses, malware, or anything designed to disrupt, damage, or gain unauthorized access to the Service or others' systems.
- Probe, scan, or test the vulnerability of, or breach the security or authentication of, the Service.
- Scrape, crawl, harvest, copy, or systematically extract content or data from the Service; use bots or automated means to access it; or bypass any access controls, paywall, or rate limits.
- Resell, redistribute, sublicense, share, or make the Library content or community available to non-members or the public.
- Use the Service to advertise, spam, solicit, run a competing service, or collect information about other members without consent.
- Give medical, legal, engineering, or other professional advice to other members in a way that presents itself as licensed professional advice.
We may investigate suspected violations and take any action we consider appropriate, including removing content, and suspending or terminating accounts.
13. Community code of conduct
The community only works if members treat each other with respect. When you participate, you agree to:
- Be respectful and constructive. No harassment, hate, bullying, or personal attacks.
- Share your own experience honestly, and make clear that it is your experience, not professional advice.
- Respect others' privacy. Do not post someone else's personal or confidential information without permission.
- Keep it relevant and honest. No spam, scams, undisclosed promotion, or misleading claims.
- Do not solicit members or steer them off-platform for prohibited purposes.
Community posts are the views of the members who write them, not of Monitor My Air. We do not verify member statements, and you should not rely on them as professional advice.
14. Your content, license, and moderation
You keep ownership of the content you post to the community or otherwise submit to the Service ("User Content"). By posting User Content, you grant Monitor My Air a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, adapt, and distribute that User Content for the purpose of operating, providing, moderating, promoting, and improving the Service. This license continues for backups and for content others have interacted with even after you remove your post, and otherwise ends within a reasonable time after you delete the User Content or your account, except as required by law.
You represent that you have the rights necessary to post your User Content and to grant this license, and that your User Content does not violate these Terms or anyone's rights. You are solely responsible for your User Content.
We are not obligated to monitor User Content, but we may review, moderate, edit, refuse, remove, restrict, or delete any User Content, and suspend or terminate any account, at any time and at our discretion, including content we consider to violate these Terms, to be harmful, or to create risk or liability. We are not responsible for User Content posted by members.
15. Intellectual property
The Library content and materials that Monitor My Air creates or curates, along with the Service's design, text, graphics, logos, trademarks, software, and organization, are owned by Monitor My Air or its licensors and are protected by intellectual property and other laws. We reserve all rights not expressly granted.
Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and view the Library content for your own personal, non-commercial use during your membership. This license does not permit you to copy, download beyond ordinary viewing, reproduce, republish, distribute, sell, rent, sublicense, publicly display, create derivative works from, scrape, or otherwise exploit the Library content, in whole or in part, except as expressly allowed by us in writing or by applicable law. All rights to the content revert or become unavailable when your membership ends.
16. Third-party links and resources
The Service may link to or reference third-party websites, products, services, tools, or resources, including our payment processor and independent experts. We provide these for convenience and do not control or endorse them, and we are not responsible for their content, policies, availability, or practices. Your use of any third-party site or service is governed by that third party's terms and is at your own risk.
17. Assumption of risk
You understand and agree that decisions and actions relating to your home, property, environment, and health carry inherent risks, and that Monitor My Air provides education and coordination only. To the fullest extent permitted by law, you knowingly and voluntarily assume all risk arising from your use of the Service, from any information you obtain through it, and from your engagement of any third party, including any inspector, laboratory, contractor, or professional. You are responsible for evaluating and acting on information at your own risk and, where appropriate, with the help of qualified licensed professionals.
18. Disclaimer of warranties
THE SERVICE, INCLUDING THE LIBRARY, COMMUNITY, DIRECTORY, CONSULTATIONS, ADVISORY, AND ALL CONTENT, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, MONITOR MY AIR DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, ACCURATE, COMPLETE, OR CURRENT, OR THAT ANY CONTENT OR THIRD PARTY WILL MEET YOUR EXPECTATIONS OR PRODUCE ANY PARTICULAR RESULT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY STATED HERE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
19. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MONITOR MY AIR AND ITS OWNER, OPERATORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, OR FOR ANY PERSONAL INJURY, ILLNESS, PROPERTY DAMAGE, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN ALL CASES, MONITOR MY AIR'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE TOTAL AMOUNT YOU ACTUALLY PAID TO MONITOR MY AIR IN THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR, IF YOU PAID NOTHING, ONE HUNDRED U.S. DOLLARS (US$100). THESE LIMITATIONS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THAT CASE, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
20. Indemnification
You agree to defend, indemnify, and hold harmless Monitor My Air and its owner, operators, affiliates, and suppliers from and against any claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms or any law or third-party right; (d) your engagement of or dealings with any independent third party, including any inspector, laboratory, contractor, or professional; or (e) any decision or action you take regarding your home, property, environment, or health. We may assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense.
21. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access to all or part of the Service at any time, with or without notice, including if you violate these Terms, if we suspect fraud or misuse, if required by law, or if we discontinue the Service. On termination, your license to the Library content ends and you must stop using it. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, assumption of risk, dispute resolution, and governing law. Termination does not entitle you to a refund except as stated in our Refund Policy or required by law.
22. Changes to the Service, pricing, and these Terms
We may add, change, suspend, or discontinue any part of the Service, and we may change our pricing, at any time. If we change recurring subscription pricing, the new price will apply to your next renewal after we give you reasonable advance notice, and you may cancel before renewal if you do not agree. We may also update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as posting the updated Terms with a new "Last updated" date or notifying you in the application. Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree, you should stop using the Service and cancel.
23. Governing law and venue
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules, and by applicable United States federal law. Subject to the dispute-resolution and arbitration sections below, you and Monitor My Air agree that the exclusive venue for any permitted court action is the state or federal courts located in or serving Virginia Beach, Virginia, and you consent to the personal jurisdiction of those courts.
24. Informal resolution first
Before starting any arbitration or lawsuit, you agree to first try to resolve the dispute informally. Send a written description of your dispute, your contact information, and the relief you seek to our Contact email. You and Monitor My Air agree to negotiate in good faith for at least sixty (60) days from the date the notice is received. This informal step is a required precondition to starting arbitration or a court action, and the deadline for any claim is paused while the parties negotiate in good faith.
25. Binding arbitration and class-action waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO GO TO COURT AND TO HAVE A JURY TRIAL.
- Agreement to arbitrate: if a dispute is not resolved through the informal process above, you and Monitor My Air agree that the dispute will be resolved by final and binding individual arbitration, rather than in court, except as noted below. The arbitration will be administered by a recognized arbitration provider under its consumer rules, and will take place in or serving Virginia Beach, Virginia, or by remote/video hearing, unless you and we agree otherwise. The arbitrator will apply the law stated in the Governing Law section.
- Class-action waiver: you and Monitor My Air agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding.
- Exceptions: either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive or equitable relief in court to protect intellectual property or address unauthorized access or misuse. Nothing here waives rights that cannot be waived under applicable law.
- Opt-out: you may opt out of this arbitration and class-action-waiver section by emailing us at the Contact address with your name, account email, and a clear statement that you opt out, within thirty (30) days of first accepting these Terms. If you opt out, the Governing Law and venue section still applies to your disputes. Opting out of arbitration does not affect any other part of these Terms.
26. General
- Entire agreement: these Terms, together with the policies they reference (including the Privacy Policy and Refund Policy) and any terms presented at purchase, are the entire agreement between you and Monitor My Air about the Service, and they supersede prior agreements on that subject.
- Severability: if any provision is held unenforceable, the rest remains in effect, and the unenforceable provision will be enforced to the maximum extent permitted.
- No waiver: our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment: you may not assign or transfer these Terms without our consent. We may assign them in connection with a merger, acquisition, sale of assets, or by operation of law.
- Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control.
- Relationship: these Terms do not create any partnership, agency, employment, or joint venture between you and Monitor My Air.
- Notices: we may provide notices to you by email or through the application; you consent to receive communications from us electronically.
